Although the EB3 Visa requirement is less demanding the process isn’t too demanding. This is because of your purpose of immigration which is employment purposes. The EB-3 visa is further divided into 3 subcategories which are

Requirements for EB3 Visa

How To Apply For a EB3 Visa

As stated earlier the application process requirement is lesser compared to the EB2 or EB1. First and foremost, you have to obtain a labor certificate by first submitting the ETA form. You don’t have to be scared. Applicants in this category do not need to be employed before filing for a labor certification. The employers must file a form of Form 1-140 and Immigration Petition for Alien Workers. Also, the employer will have to submit a report on how to pay your wages. The employer may submit an annual report, federal income tax return, or an audited financial statement. Below is a detailed procedure to apply for an EB3 visa

  • Obtain a labor certification.
  • Your employer needs to complete the form 1-140
  • Submit your filing fees
  • Submit your evidence
  • Finally, you should sign and file the form 1-140.

Finally, once the USCIS receives your form 1-140. Then the petition will be processed, then your employer will receive a confirmation message. It is important to note that it takes about six months to process forms 1-140. The process involved can be longer depending on your choice of country.
